Privacy Policy

Bays and Bens Holidays (“we”) are committed to operating in an open, fair, lawful and transparent manner when processing and using your data for Bays and Holidays.  Any data that we collect is used and stored in a safe manner.

This policy (together with our terms of use and any other documents referred to in it) sets out the basis on which any personal data we collect from you, or that you provide to us, will be processed by.

Definitions
Data Subject - a living individual.
Data Controller - person or organisation who determines how personal data will be processed.
Data Processor - person or organisation who is contracted to process personal data on behalf of a Data Controller.
Processing - anything done by a business with personal data – collecting, recording, storing, combining and destroying.
Data  - any data relating to an identifiable person – name, passport number, home address, private email address, racial and ethnic origin, sexual orientation, health data, union membership, political opinions, religious or philosophical beliefs.

Who are we?
Bays and Bens Holidays is the Data Controller.  We collect and manage your personal data in accordance with our policy. 

Personal data involved
Data Controller     - name – address – email address – phone numbers
Data Processors   - name – address – email address – phone numbers – payment details

The data I hold for you here at Bays and Bens Holidays is quite simple.  I hold your name, address, phone numbers and email address.  We also keep a note of who you booked through, how many people in the party what you have paid and by what method.

Any financial data ie bank account details and credit card details is stored by my booking management provider – “Holiday Bookings Online Ltd” or by your booking agent – Airbnb, Tripadviser, Booking.com etc.  My booking management provider and agents are all GDPR compliant and their policies can be viewed on their websites.

How we use/process your data
As controller we do use your data but in a very minimal way.  We may occasionally contact you with information for booking again in the future.  We are more likely to use your data to send back your security deposit or to return left items to you.  We do not keep financial details and if we’ve asked you to provide these to me to return your deposit direct to your bank account then they will be deleted straight away.  Your data (name, amount paid) is entered into our accounts program provided by Zero and audited by our accountants R A Clement both of whom are GDPR compliant.

You may give us information about yourself by filling in forms on our website or by corresponding with us by phone, email, social media etc.  This includes information you give us when you make an enquiry or a booking on our site.

What is our legal basis for processing your personal data?
Personal data (article 6 of GDPR)
Our lawful basis for processing your general personal data is based on your opt in consent for your data to be used to receive communications on your holiday.

Storing and sharing your personal data
Your personal data will be treated as strictly confidential.  Your data is stored by us on our secure bookings’ website and any processing of that data is done inhouse and it is not shared for marketing or any other use with outside processors.

How long do we keep your personal data?
We keep your personal data for no longer than reasonably necessary.  We only retain your data for the following purposes to help facilitate future bookings.  Our subscription database will be reviewed regularly.

Providing us with your personal data
We require your personal data as it is a requirement booking your holiday to allow us to contact you for the purposes of providing your holiday.  We will not use your data for any other purposes without seeking your prior approval.

Your rights and your personal data
Unless subject to an exemption under the GDPR, you have the following rights with respect to your personal data:

- The right to request a copy of the personal data which we hold about you.
- The right to request that we correct any personal data if it is found to be inaccurate or out of date.
- The right to request your personal data is erased where it is no longer necessary to retain such data
- The right to withdraw your consent to the processing at any time, where consent was your lawful basis for processing the data.
- The right to request that we provide you with your personal data and where possible, to transmit that data directly to another data controller, (known as the right to data portability), (where applicable i.e. where the processing is based on consent or is necessary for the performance of a contract with the data subject and where the data controller processes the data by automated means).
- The right, where there is a dispute in relation to the accuracy or processing of your personal data, to request a restriction is placed on further processing.
- The right to object to the processing of personal data, (where applicable i.e. where processing is based on legitimate interests (or the performance of a task in the public interest/exercise of official authority); direct marketing and processing for the purposes of scientific/historical research and statistics).

Transfer of Data Abroad
We do not transfer personal data outside the EEA.

Automated Decision Making
We do not use any form of automated decision making in our business.

Further processing
If we wish to use your personal data for a new purpose, not covered by this Data Privacy Notice, then we will provide you with a new notice explaining this new use for you to opt in prior to commencing the processing and setting out the relevant purposes and processing conditions.

Changes to our privacy policy
Any changes we may make to our privacy policy in the future will be posted on this page and, where appropriate, notified to you by e-mail. Please check back frequently to see any updates or changes to our privacy policy.
